Terms and Conditions for Viv’s Place Coaching Services
This Agreement is entered into whereby the Coach (“Viv’s Place”) agrees to provide Coaching Services for the Client (“you”) focusing on the topics, results, outcomes, and goals outlined in Schedule A attached to this
Agreement.
Description of Coaching
Coaching at Viv’s Place is a partnership (defined as an alliance, not a legal business partnership) between Viv’s Place and the Client. It is a thought-provoking and creative process designed to inspire the Client to
maximize their personal and professional potential. Coaching facilitates the creation and development of personal, professional, or business goals and the execution of strategies/plans to achieve them.
Coach-Client Relationship
A. Viv’s Place will maintain the ethics and standards of behavior established by the International Coach Federation (ICF) (www.coachfederation.org/ethics).
B. The Client is solely responsible for their own physical, mental, and emotional well-being, decisions, choices, actions, and results stemming from the coaching relationship and interactions with Viv’s Place. Viv’s Place is not liable for any actions or inactions or for direct or indirect results of any services provided.
C. Coaching is not therapy, nor does it substitute for therapy, medical treatment, or mental health care. Viv’s
Place does not diagnose, cure, or treat any medical or mental health conditions.
D. The Client may terminate the coaching relationship at any time (refer to the “Terms of Payment”).
E. Coaching at Viv’s Place is a comprehensive process that may involve aspects of the Client’s life such as work, finances, health, relationships, and recreation. The Client is responsible for deciding how to handle these areas and for implementing choices based on coaching principles.
F. Coaching does not include diagnosing or treating mental health conditions. Clients currently under the care of a mental health professional must disclose this to Viv’s Place and provide written consent from their practitioner before coaching can commence. Viv’s Place reserves the right to refuse coaching services in these situations.
G. The Client agrees to communicate honestly, remain open to feedback, and commit time and energy to participate fully in the coaching program.
Services
Viv’s Place and the Client agree to engage in a Coaching Program as outlined in Schedule A. Between-session email support may be provided, as defined in Session #1. Additional time may be made available at the hourly/project rate, as agreed upon prior to service delivery.
Schedule and Fees
A. Coaching services are charged as outlined in Schedule A, including sessions, between-session emails/calls, and other agreed services.
B. Session duration is detailed in Schedule A.
C. If rates change before this agreement is signed, the new prevailing rates will apply.
D. Refunds are subject to the Refund Policy in Schedule A.
Procedure
Session times and locations will be mutually agreed upon. For phone/online sessions, the Client will initiate calls using the provided contact details.
Confidentiality
A. The coaching relationship and any information shared with Viv’s Place are subject to the confidentiality principles outlined in the ICF Code of Ethics. However, communications are not subject to legal privilege.
Viv’s Place will not disclose Client information without prior written consent.
B. Exceptions to confidentiality include:
• Information known to Viv’s Place prior to disclosure by the Client.
• Information generally known to the public or the Client’s industry.
• Information obtained from a third party without obligation to the Client.
• Information required by law, subpoena, or court order.
• Situations involving imminent harm to the Client or others.
• Disclosure of illegal activities.
The Client is responsible for raising confidentiality questions or concerns in a timely manner.
Refund Policy
Refunds will not be issued under the following conditions:
• Failure to attend a scheduled session (in-person, online, or phone).
• Termination of a pre-purchased coaching program. A percentage refund may be issued at Viv’s Place’s discretion based on notice period and termination reason.
• Cancellation of a pre-purchased session with less than 48 hours’ notice.
Refunds or transfers may apply in these cases:
• If Viv’s Place cancels a session, a new session will be scheduled.
• No refunds are provided after the completion of a coaching session.
Terms of Payment
Payment is required in full prior to the delivery of services. Accepted payment methods will be noted on the invoice.
• Clients paying via EFT must email the payment receipt to Viv’s Place at the time of payment.
• Paid fees may be transferred to future sessions if cancellations are made with at least 48 hours’ written notice.
• If Viv’s Place cancels a session, fees will be transferred to a future session. Refunds are not issued.
In the unlikely event that Viv’s Place terminates services, unused session fees will be refunded within 48 hours of written notice of termination.
